YOU BE THE JUDGE
Tyrone Noling is no angel, but he did not kill Bearnhardt and Cora Hartig. He was convicted and sentenced to death as the result of extensive pretrial publicity emphasizing his involvement in two armed robberies in Alliance and connecting him and his alleged accomplices to the Hartig murders, as the result of a campaign by prosecutors to coerce the alleged accomplices into falsely implicating themselves and Tyrone, as the result of trial counsels' failure to expose this prosecutorial misconduct and to present evidence of Tyrone's actual innocence, and as a result of the prosecution's using Tyrone's admitted involvement in the Hughes/Murphy robberies immediately preceding the
Hartig murders to prejudice the jury against him.
Following is a summary of Tyrone Noling's case of actual innocence. This is only a summary. The full story is contained in the petition for postconviction relief and amendments to the petition originally filed in the Portage County Court of Common Pleas in Case No. 95-CR-220 in 1997. The petition and amendments to the petition are supported by documentation, including testimony in the form of affidavits from the witnesses who demonstrate Tyrone's actual innocence. You should read the petition and amendments to the petition and review the supporting documentation and affidavits for a full appreciation of the overwhelming strength of Tyrone's case. Following this summary is a brief timeline listing the key dates in the prosecution of Tyrone Noling. It is important to keep in mind that much of what is discussed below was not presented at trial by Tyrone Noling's trial counsel.
